At 1031X, we guarantee exceptional execution and 5-star service for your exchange. If we fail to meet our service standards, we’ll refund our exchange fee. Period.

This guarantee applies to all standard forward 1031 exchanges and covers our complete exchange fee. 

We can’t control the IRS or market conditions, but we absolutely guarantee the quality of our service. 

 No complex claims process, no “gotcha” exceptions. 

How It Works

We’ll refund fees for all standard forward 1031 exchanges, including fees for additional sales and purchases.

For reverse and construction 1031 exchanges, the refund covers double the standard forward exhange fee. 

While our guarantee covers the most common fees, there are services and associated expenses that are limited or for which the guarantee does not apply. 

These include

  • Limited to exchange fees paid to 1031X (excludes third-party fees)
  • Limited to one claim per exchange
  • Not applied to mail, FedEx, or other expenses incurred
  • Not applied to any earned interest
  • Not applied to improvement expenses, advisors, contractors, or other associated parties
  • Not applied to any other exchange party with whom the client or 1031X contract with for purposes of assisting the 1031 exchange process

Other exclusions apply, including:

  • Third-party delays or errors outside of 1031X’s direct control
  • Force majeure events
  • Client-caused delays or failures to provide required information
  • Matters related to investment performance or tax outcomes
  • Issues arising from client’s failure to meet exchange deadlines
  • Issues arising from market conditions
  • Regulatory changes

To submit a claim and request a refund,

  1. Provide written notice of service failure within 5 business days
  2. Include a specific description of the problem (service standard violation)
  3. Submit via email or client portal

Claims for refund are valid during active exchanges and must be claimed prior to exchange completion. 

This period is extended if a 1031 exchange is rejected by the Internal Revenue Service or state department of revenue dur to clear and obvious error by 1031X.  In such a circumstance, claim must be submitted within 5 business days of notice by the IRS or state department or revenue. 

We take each claim extremely seriously.  

We promise to

  • Acknowledge the claim within 1 business day
  • Complete an investigation within 5 business days
  • Provide you with written determination by senior management upon completion of investigation

Client obligations are to

  • Respond to information requests in a timely manner
  • Provide honest and accurate information related to the claim and investigation
  • Maintain best efforts to satisfy exchange requirements
  • Maintain adherence to stated deadlines

For any accepted claim, 1031X preserves all legal rights. No admission of wrongdoing. 

Claim is a guarantee of service, not a guarantee of outcomes

  • Not a guarantee of finding adequate replacement property
  • Not a guarantee of closing within exchange deadlines
  • Not a guarantee of acceptance by IRS or survivability upon audit (excepting cases where clear 1031X documentation errors/failures or fund handling mistakes place the client outside of the safe harbor)

Refunds will be processed within 30 business days of a completed investigation (if warranted).

If we fail to meet our documented service standards, 1031X, LLC will refund your exchange fee upon your request. Refund requests must be received within five (5) business days of the service failure and prior to completion of your exchange. The guarantee covers standard exchange fees paid to 1031X for forward 1031 exchanges, including fees for additional sales and purchases. For reverse and improvement exchanges, refunds are limited to double the standard forward exchange fee. The guarantee applies only to 1031X’s services as a Qualified Intermediary and does not cover services provided in any capacity as attorney, accountant, broker, financial advisor, or services provided by third parties contracted in connection with your exchange. The guarantee is a promise of service quality, not a guarantee of outcomes, including but not limited to: finding adequate replacement property, meeting exchange deadlines, IRS acceptance, or audit survivability. The guarantee does not cover: third-party delays or errors outside 1031X’s direct control; force majeure events (including natural disasters, pandemics, war, terrorism, power outages, banking system disruptions, government actions, or other circumstances beyond our reasonable control); client-caused delays or failures to provide required information; matters related to investment performance, tax outcomes, or market conditions; regulatory changes; or expenses such as wire fees, postage, earned interest, or improvement expenses. The guarantee is only available to clients in good standing who have executed all required exchange documents, provided timely responses to information requests, and adhered to stated deadlines. Refund requests must include written notice with specific description of the service standard violation submitted via email or client portal. Refunds will be processed within thirty (30) business days of a valid determination. The determination process includes acknowledgment within one (1) business day and investigation completed within five (5) business days, with final decision made by senior management. Refunds do not constitute admission of wrongdoing, and 1031X preserves all legal rights. Other restrictions may apply. 1031X reserves the right to change or terminate this guarantee at any time with appropriate notice.
